Affectation of the principle of contradiction in the Integral Penal Organic Code in the expert evidence
Abstract
The objective is to analyze the affectation of the principle of contradiction in the Comprehensive Organic Criminal Code in the expert evidence. The research has a documentary descriptive methodological perspective with a bibliographic design, generating a reflective process as a research product. The lack of participation of external experts or those not qualified by the Council of the Judiciary violates the principle of contradiction since, if an expert is required to refute another, he or she must be qualified by the same collegiate body, and to refute what was stated by the prosecutor's expert, this will not be summoned by the prosecutor's office to carry out expert reports that were required by them.
