Criminal imputability in fortuitous cases that partially deprive the conscience of individuals

Abstract

The objective of this article was to analyze criminal imputability in fortuitous cases that have partially deprived individuals of their consciousness. The research was based on a quantitative and descriptive approach, using surveys of 60 legal and mental health professionals to analyze the effectiveness of Ecuadorian legal provisions. The results indicated that, according to the respondents, current legislation has not provided adequate mechanisms for assessing the imputability of individuals with temporary mental disorders. Despite regulatory advances in Ecuador, significant challenges have persisted in their practical application. In addition, the need to implement training programs for judges and lawyers on the intersection between mental health and criminal law was highlighted. This study highlighted the importance of a more comprehensive and equitable approach to the assessment of criminal culpability in Ecuador.
