Civil remedies after the expiration of the statute of limitations
Abstract
This study analyzed the subsistence and nature of civil reparation after the statute of limitations of the criminal action, highlighting its autonomous character, of a civil nature and with an essentially compensatory function in the protection of the victim's rights. The research was of a mixed type, using the hermeneutic method and legal argumentation at the dogmatic-legal level to interpret doctrine, legislation and national jurisprudence, applying a survey to 20 lawyers specialized in criminal and civil law at the empirical level, which was evaluated with a five-point Likert scale. The results showed coincidence between doctrine, norm and jurisprudence regarding the subsistence of civil reparation, although there are still deficiencies in the normative clarity and uniformity of jurisprudential criteria. It was concluded, therefore, that its effectiveness should require normative and procedural instruments that guarantee its compensatory function and the effective protection of the victim's rights.
