The right to formal and substantive equality and its implications for labor rights
Abstract
The objective of this research was to analyze the relationship between the right to formal and material equality and its implications for labor rights in Ecuador. The methodology was a qualitative approach at the descriptive and analytical level, focused on the analysis of cases related to formal and material equality in labor rights. The results and analysis of the cases presented in this study show that, although Ecuador has made progress in legislation on labor equality, significant gaps remain between formal and substantive equality. While current regulations establish express rights and prohibitions against discrimination in the workplace, their effective application is hampered by social, cultural, and structural factors that limit real access to labor equity. In conclusion, there is a need for a firm commitment from both the State and companies to achieve substantive changes in working conditions.
