Guarantee of the motivation of administrative acts. Limitation on the arbitrariness of public administration.
Abstract
The overall objective of the research was to analyze the guarantee of motivation in administrative acts. Limiting the arbitrariness of public administration. The approach taken by the researchers to develop the method was through investigation, collection, and critical analysis of documents and bibliographic references, based on the methodical, rigorous, and in-depth exploration of various documentary sources consisting of peer-reviewed articles and laws, describing the findings. The inductive-deductive method was also used. It is concluded that the guarantee of motivation is an essential element when issuing administrative acts, as it helps to avoid arbitrariness and control discretion in the public sector. It was demonstrated that the absence of motivation can lead to unfair decisions, which has a direct impact on the rights of those being managed and, in turn, undermines their trust in public institutions.
